You can get a DUI even if you blow below .08. The law is 2 parted. 1- you go over.08 or 2 driving in a manner, because of alcohol, that is deemed unreasonable.

Said we had weapons and were fighting people in the parking lot... Anyway, both of the times he's pulled me in Concord he was cool.

If I remember my lawyer said some shit that up to a point your level will continue to go up as your body metabolizes the alcohol even after you stop drinking.

He was gonna bring in a scientific expert or some shit if we had to take it to trial.

he was crazy that night on me. i'm white by the way and have never been let go for anything while i'm driving. been let go for trees a couple times but i was never driving.

i just gotta wait for my results and hearing and go from there.

and to the guy that said personal responsibility bullshit... had i actually been drunk and had my driving shown that; it would be a much different story. i literally was driving perfect and was not intoxicated. first question on my temporary license about the hearing says was there reasonable cause to be suspected of a dui? the answer is definitely no and i'm glad i had a witness in the car with me.

fuck concord/clayton. cops dont got shit to do except fuck with kids for bullshit. i'm gonna move somewhere with problems so cops have real work to do.

your shit is getting suspended no matter what. the dmv couldn't give half a shit about the court. you can beat your case and your shit is still getting suspended cuz you blew a .08, period. end of story.

I blew a .10 on the highway and a .09 at the station. the DA offered a wet reckless and when the public defender broke down the fines and shit I took it. dui makes you do community service and a fat ass fine as well as longer jail time (which is usually waived as time served). also there was the first offender program and the dui would have you do like 3 months, 6 months or 9 months. with the wet reckless I got no community service, less than a thou-wow in fines and a 12 hour (6 week) program. I also got credit for time served for the night in the drunk tank.

let me ask you this, do you have your license now or do you have a piece of paper?

good info defy. but i still gotta try to beat it. if my blood tests come back below .08... the breathalyzer will be tossed out. it isnt as accurate. and the temp license i have says if the chemical test shows below .08 my license wont be suspended or revoked

you are correct. but i still gotta fight.

i hate how separate the court and dmv is

..it's so hard to get both in sync
yeah its retarded. my shit was suspended and i paid everything off but for some reason a hold wasnt lifted until over a month after it should have been cleared. i kept calling and trying to figure it out and everyone at the courthouse kept giving me different answers/stories. this was the oakland courthouse.

Gotta man up, lol

I'm sorry, but I can't have any sympathy for your situation. You could easily be lying in your initial post to sway people in your favor (not saying that's the case).

Don't drink and drive kiddies, or you'll end up like franchise :hurt:

sway people in my favor? wtf good would that do? none.

i explained my situation exactly how it happened so that i could possibly get useful advice about my case.

i dont want or need sympathy from anyone about anything. i'm confident that i'll win this battle. and if i dont, i'll take the consequences and deal with it.

the dont drink and drive slogan has been posted numerous times. go to church mrpeete
