I got fired before and had my benefits denied until I filed an appeal and had a phone interview where they and I spoke at the same time as to the facts. they had my supervisor, the operations manager I want to say the vice president of the company on their end and just me on the other. needless to say they were served and my benefits were in the mail.

As for your situation I think you should have at least been smart enough to bring it up instead of just assuming there would be no penalty. On the other hand if someone said that to you, you will be able to use that to your advantage. Also if you know of anyone else that worked there that did the same thing with no penalty you should bring that up too .. But if neither of those apply then I dont know what to tell you other than start looking for a job instead of posting here

"Willful misconduct. Employee was discharged for dishonesty. Honesty is expected of an employee. The employee's actions are determined to be a willful and substantial disregard of the employer's interests. "

I was signed up to take a test for work. A continuing education test that had no effect on my ability to do my job. Not passing would not have kept me from doing as good a job as I was doing nor prevent me from excelling in the future.

I didn't take the test. I didn't think not taking the test would be a big deal. I thought not taking the test was the same as taking a zero and not passing. Not passing was not punished EVER. They said it was a big deal and that I lied. I said I didn't know it was a big deal and would make up the time and pay for the test if needed. So they fired me. Because I was dishonest.
Maybe they wanted to get rid of you for a long time now and didn't have an excuse till now..

Best of luck to all you dealin with EDD.

Im goin thru it too.
I got laid off in April of 2008...and am now on my 4th round of unemployment. I had my first round, then the extension..then the federal government implemented an extra extension...now as of May 1, California implemented FED ED, which is the 4th extension and I'm about collect a few more racks on that. Only think different is, now I have to log my job search, which is nothin' 'cause I've been doing that all along.

I was fired and received umemployment. Went through the appeals process after the job told'em I was fired. Best advice I can give you is be prepared to prove your case and do your research. I actually got one of those free lawywer's (the broad was fresh outta hasting and hadnt even passed the bar) and I won my case in front of the judge with my former director and the director of HR in the room. We clowned those foo's! They probly thought I was gonna show up with nothing but we had a series of questions and answers prepped to get my side of the story out! Worked and I got like 5 checks in one week! Best part was the look of former employers face when we walked out! The judge had rendered them speechless with his questions too..muahahaha

Why would they give free money to morons who didn't do what they were supposed to or broke the rules?

I'm not aiming that at you btw, but if that was the case then people would be getting fired on purpose so that they didn't hafta work like the rest of us. They could just go take a dump on the bosses desk and then get checks every week lol
I thought that's how it worked. I've heard of people doing far more retarded shit than I did and getting unemployment.
