Racial profiling by LPD

First I wanna apologize that this isnt ECCR related, but alot of people visit this forum and may be able to help out. I also put this in the gathering of the minds forum

Well, a friend of mine, along with myself were pulled over last night by LPD and were racially profiled as being gang members because:

1. We are mexican
2. He had on a red belt, while my watch was red.

We were leaving my apartments when a cop pulled up. My friend backed up to let him in(driveway is small) and the cop never made eye contact, so we knew what was going to happen. Any way, we were on our way to a friends house when we werent even 200 yards from my aparments when we get pulled over by the cop we let into the apartments.

He came up to the car and said we were pulled over because my friends Caddy didnt have a license plate on the front of the car. We were then told to get our of the vehicle and had to give them all our info and also had our pictures taken like some fucking models. And now we are both on the LPD gang files.

We are planning on taking these fucking pigs to court, along with the city of Livermore. Before that can happen I am gonna get some legal advice from my Uncle to see what our options are. We also have 3 witnesses who were watching the whole time.

So I was wondering if any of you think we could have a case on our hands. Why or why not? I just wanna know what yall think we can do, before I go to my Uncle for advice.

The pigs around here willl do anything to pull you over. If they see you tossin a cig out the car, they'll pull you over and call for back up. Then they'll do the standard procedure,

"STEP OUT OF THE CAR, GET ON THE GROUND" bullshit

For you they'll probably pull that ol bullshit line, "YOU FIT THE DESCRIPTiON" quote in court, but if you are very serious about this case, you must be persistant. Try to get the witnessses to testify in anyway how you were harrased, and were not treated along police guidelines. It might be a challenge to win the case against the pigs, but you probably got a better chance with suing the city.

@RIX, True, you need a license plate, but the thing is, they didnt even go about it like that. Thats what the pig said at first, but if thats all it was about, nigga, they would have been done gave my homeboy a fix-it ticket. Yea my friend who is black, was driving pretty drunk but wasnt showing it, was pulled over cuz he didnt put his signal on. I was high as fuck and i had a 18 pack filled with empty bottles by my feet. the cop came over, took my friend out of the car asked him some questions then called back up and a cop came over to the car took me and my two other friends out and made us sit on the pavement. My friend passed all of the sobriety tests and shit and they took him to the station and by the time they breathalized him he was 0.01 which is legal if your 18. He got slapped with a MIP and got his liscenes suspended for a year, hella weak.
Another friend of mine who is white was driving drunk and one of my friends threw some beer bottles and hit some guys car, he came out and started chasing him with his car. My friend turned the corner to fast and drove on somones lawn near some children. Police came and slapped him with only a open container of beer.

Same friend who is black was riding with my friend at 2 am and a cop pulled them over saying theyre looking for a green car with a black guy in it cuz they had reports of a black guy in a green car smashing windows with a bat. They "supposily" found blunt ashes in the car and began to search the car and found a quarter in a cd case. They asked my white friend if the black guy was the dealer, and saying are u sure over and over. Fuckin pigs racially profiling everything think my friend was a dealer jus cuz hes black man fuck that

Real talk, I appreciate everyones input on this. I got some good info from White Devil about seeking out the Criminal Justice course here in Livermore at the Community College. Ill try and keep this posted and see what comes out of it. I still need to contact my uncle. Shit I may even see if I can speak with the DA about this. Even if the bread comes out my paycheck, Ill try and have some good representation for this. Again, good lookin everyone.

This sounds like a case of racial profiling that can hold ground in the court. I have a question are the witnesses willing to attend court with you? Were they friends of yours? What was there postional point of veiwing? I am asking you this because when I got into a car accident all my witnesses were homies of mine not in the car and the court did not allow them to testify. There was also an old lady across the street who viewed the crash and the court did not allow her to tell her story of the accident; because her viewing point did not meet satisfaction. I am still going to court for this so........................It's been more of a watse of time for me then any thing else and if I win the money is going to be very small. I am guessing a $500.00 check and nothing above.

i got pulled over by the gang unit not all that long ago. they said i had bad tags on my car... i didn't. they pulled me over cause i was sportin a red SF beanie and jacket and was bumpin some music.

they jotted my name down in their little notebook and shit...

I am gonna try and see if I can speak with the witnesses tomorrow. The witnesses were no more than 20 feet away right behind us while this was going on. Cuz you know that once the lights of the 50 show, people come out side and see whats going on. They cant be told to go inside, unless there is something big going on, that is viable to get them hurt. Just make sure that you arent the one at fault, and the other person has good insurance. Good lookin on the info though, hopefully our witnesses will be willing and able to testify.

I really dont care how long this takes for me, I want some justice. Fuck the dumbshit. But as I said, I am gonna get legal advice before I follow through with the case. Cuz if the DA thinks we may not have a case, the I might have to let it go...legally anyways, cuz this will always be on my mind.

I really dont think that it is proper protocol for the policia doing shit like that. I cant believe I wanted to be a pig when I was little...gotdamnit. Stay up though man, I dont know when that happend to you, but if it wasnt to long ago, you should see if you could also get a case. cuz you know them pigs be havin them dash board cams with audio to catch every word spoken.

I mean, if we can at least get our names erased and pictures back, then it would be all good. but untill that happens, I am gonna see what I can do on my part.

A Wood you seem to like talking about subjects like this what gives you your drive to fight against the government? I some time have the desire to fight against the government, but it seems the people always lose and will continue.

yeah i feel you. on another situation i had a camcorder confiscated. my homie was driving another homies car and we got pulled over for a turn signal being out. when they found out the car didn't belong to any of us we went through that same shit. we got photographed and sat on the curb, the homie driving was in the back of the cop car. they took everything out of the car, searched everyone pretty thorough, including looking through every pocket in our wallets. they were flipping through the penal code book trying hard to find a reason to take us to jail. but the thing that bugged me the most is they took my camcorder for "criminal observation"... all that was on there was me and homies acting stupid and some backyard boxing matches.

luckily i have a friend that i help out who's a business attorney. not the specific kind of attorney i need, but he was helpful enough to let me understand my rights about that situation. he gave me some good advice. he suggested i give the police a choice... either they give me my camera back, or i would take the officer to small claims court and sue him for the price of the camera and violating my fourth amendment rights. worked like a charm cause they said "let me call you right back". and 5 minutes later i got a call saying "come pick up the camera"...

that felt great. it was like getting a victory over these fuckers.

i talked to my attorney homie about getting harassed by cops. he said it's actually possible to try to get a special restraining order against the police. i guess if you get that and cops keep fucking with you, and you can prove they're doing it for no reason, you can get some big money in court... i don't know how true it is, but i'm gonna talk to him about that some more. i'd imagine it'd be hard for anyone with a criminal record to get one, so i'm out. but maybe you could look into it.
