well i guess that that makes me a double-dork.

before i was able to be a composer 24/7 i did a lot of work in entertainment law as a guy who licensed stuff, renewed copyrights etc. for BMI. i know that one has to incorporate in a specified state (i chose Delaware becuase they have made themselves a coporate haven for their economy) and I had to also register in New York because that's where I'd be doing business and where the actual address of Strange Music Inc. is registered.

Even though, I also know that the registration is good all through the USA and most of Europe and all other territories the US signed intellectual property agreements with within the Sherman Anitrust Act.

Yeah, it's a pain in the ass but one has to accept these things if one wants to be a player in the entertainment field.

that's a good question.

the name is registered, without doubt.

now, a tradeMARK, as it is defined, is actually a graphic.

that's why "coca-cola" is both "R" AND "TM" because we know it through it's graphic as the with curvy letters on a red background AND as the actual (no matter how it looks) "coca-cola".

an example: if the hamburger franchise Wendy's used an upside-down graphic from McDonalds, thereby turning an "M" into a "W", McDonalds couldn't go after them for the use of the "W" but it could say that their trademark (graphic) was being ripped-off.

does that make sense?

Arts) , and (Strange Music ) have existed since 1997 when Tech N9ne signed his first publishing deal. Strange Music Inc is a Missouri corp with foreign corp status in several states. We were made aware of your co. when we went register the domain (Strange Music). Even though both Tech and myself were irritated and disappointed, this was not the only domain name issue i.e.( therealtechn9ne.com ) we did not feel it necessary, or time well spent to pursue the issue. Even though it appears that we may have a legal advantage do to your posting of the articles of inc of your co, we do not feel that our fans message board is the appropriate place to debate such an issue.

i think he meant that when they went to register strangemusic.com it was taken (by you), so that is why they chose strangemusicinc.com. and if you do a whois on that domain you will see that strangemusicinc.com was registered in 2003. so he was saying that they saw that you had strangemusic.com in 2003, but decided not to do anything about it.

How can Travis and Aaoron claim to be Strange Music "INC." if, by law, there can only be one "INC."?

And, "2001" doesn't beat "1998" by any measure I know in terms of previousness.

Here's something you should be into... Tech makes a name for strange music, and people are logging on to "Strangemusic.com" regardless of whether or not they realize it's your site and not Techs... Are you going to complain all of a sudden that you're getting double the hits?

while tech and company might have taken the name Strange Music in 97, i really doubt they incorporated it. this dude actually showed documentation on his corp status. if tech had it incorporated before him, then there would be no possible way he would have gotten his incorporated.

Tech has established himself, and alot of other artists w/ "Strange Music". Stange is Tech, Tech is Strange. You are somebody who chose it for the hell of it because your (who knows how many different names you've tried) have fallen through. If you are gonna live and die as having the name Strange, then why not change your shit to "Strange Muzik" or something to that effect. Just think about whos making moves and who isnt.

who said this guys isn't amking moves? if you look at his bio you can clearly see he is a respected person within musical circles. it doesn't matter if tech has established himself with that name because as far as we can tell (by the proper documentation that he supplied us with) owns the name strange music.

That is so one sided man...

To the people that listen to his music he could be "strange Music" in their eyes, and who is to say he isn't making moves...take a better look at his webpage. This dude has a very, very complete resume and appears to be doing some very cool things.

Look at it this way...one of his fans could just as easily say...who in the hell is Tech N9ne, P Grant is making moves...neither fan bases would recognize the other since the music appears to be VERY different.

Just a thought. I just want to see how this plays out, becuase I, like Shep, am very interested in business law.

they haven't shown they have legal advantage.... if the guy incorporated it in 98, he obviously owns strange music inc. they do a name search when you try to incorporate your company. obviously tech's strange music was not a strange music in back then.

yeh shep i understand all that you pointed out i was just making blatant statemnts about strange music being used widely and i didnt know this guy claimed to have a trademark okay. i understand the issue with band aid and all that. but he hasn't shown proof of trademark or sole rights to name whether its inc or not.

and zero go to college you can get a degree too. or i can charge you per session but i won't take advantage of you like pgrant's lawyers

a trademark doesn't matter... wht you are thinking of is trade name, but in a case like this, it doesn't matter because it is a registered corporation. there can only be one strange music, inc by law.
