I'm so sorry that y'all believe in censorship but Strange Music Inc. is previously registered and cannot be used be Tech N9ne. Now, understand, he's a great artist and I like his music (really) but he can't take my property. I can't believe that you're so low to have deleted my previous posts. That's so lame.

So again, here's the proof, where's yours?:

It is an interesting tactic. Seems to me if I was running a company by the name of Strange Music and was concerned about another company of the same name the first communication the other company heard from me would be a letter from my lawyer, not a post on a Internet fansite. That's just me, tho.

Who is to say he hasn't also done this? What if he is having trouble getting at them? Who is to say he knows this a "fan site" and not something ran by Strange?

Hell, maybe he did.

If he's really got any legal standing, he won't have trouble getting at anyone. Subpoenas tend to get people's attention.

I think it's pretty clear this is a message board for the discussion of Strange Music.

Posting on here does nothing to advance his stated goal from the other message of a resolution. What it does do is attract attention to his company and attempt to create a negative image of Strange Music KC.

JMO, of course.

Always one to miss the point....

This made me wonder about strangemusic.com What was the URL of that site that got posted on here awhile back that just had a flash saying the Strange site was coming soon?

I would've guessed that was strangemusic.com, but apparently I'd be wrong.

yo shit is only good fo delaware and new york that won't fly in missouri. i believe strange has been around just as long as your ass and how the fuck is someone taking yo shit you will be takin tech's shit if anything. your docs don't say you have sole rights to name it just says the name of your corp is.......... how low for you to post something this serious on a fan message board wtf.

not necessarily.... if it is a trade name then it can be applied to all states.

trade names are protected under common law. trade names must be unusual or fancifully used if they are to be protected. i.e. Safeway is a trade name and can be protected against use by other people/companies.

a company can trade mark their name if the name of the product is associated with the name of the company. i.e. coca cola

yeah that may be true but do a search for strange music and you'll find several other companies and shit branding items as strange music even the name of a flower i know its not a company name but strange music in general seems to be as common as the word coffee

yes, but people ask for Band-Aids al the time.... Band-Aid is a registered trade mark and is not to be used by any other company, they are called adhesive bandages.

there's a lot of name brands that have made their way into our everyday speech that shouldn't be. No matter how common they are, they are protected against use if someone owns that name.

BUT--- that doesn't mean that any other company can call themselves "Band Aid", "Jell-O", Vaseline" "Klennex", etc.

Once a name has been registered, no matter what stare it was done in, is good for all fifty of them and any other territories participating in the Sherman Ani-Trust Act.

not my opinion: a fact.

yeah, thanks, i'm glad we agree. tech seems to be a great and productive artist. all my props to him. it's just unfortunate that his legal folks didn't do a thorough search before using a name that had been previously registered. (if fact, it's illegal to say that one is "Inc." or incorporated if they are not actually so). It's a long process with lawyers to do the search to be sure that one can register a unique name and it cost me dearly to do so in 1998.

i've no animosity towards tech and his crew, in fact, i'm a bit bemused by how the law works, but, in the end, he's going to have to drop the name and find something else. his music's his music, it won't change how it sounds, of course, but it's only fair that the name "Strange Music" goes to the registered owner (and believe me that every other cool name i thought i had come up with with was met with a negatory response from my legal team until we found one that wasn't taken i.e. "Strange Music").

i'm just interested to see what Tech's Strange has to say. i am a dork and find business law interesting. interested in seeing how this all plays out.
