A man turned himself in to police Wednesday for questioning in the shooting death of Proof.
Police also said it was Proof who fired the first bullet in the Detroit nightclub shootout that ended his life early Tuesday.
The bullet hit Keith Bender in the head, critically injuring him at the CCC, a nightclub in a strip of businesses along Eight Mile Road, made famous in the 2002 film starring Proof's close friend, rap superstar Eminem.
Mario Etheridge, 28, a cousin of Bender's and a bouncer at the club, met with police Wednesday, the Detroit Free Press reported.
"He came in because the Detroit Police Department asked him to," Etheridge's attorney, Randall Upshaw of Lathrup Village, told television station WXYZ. "Does that sound like a murderer?"
Upshaw would not say whether his client shot Proof but said whoever shot the rapper did so in self-defense.
Investigators believe Proof was fatally shot after he pistol-whipped and shot Bender following a fight at the club about 4:30 a.m. Tuesday, more than two hours after the nightclub was required to close for the night, the Free Press reported.
"The understanding of every witness we've spoken to is that Proof pulled out a weapon," Upshaw said. "Proof shot Keith in the face, and Keith was unarmed."
If Proof was shot by someone trying to protect himself or another, the shooter won't be charged, police Sgt. Eren Stephens said.
Proof, 32, whose real name is Deshaun Holton, was taken to a nearby outpatient treatment center by private car, where he was pronounced dead. He was shot three times in the head and chest, according to the Wayne County medical examiner's office.
Police said officers responding to 911 calls about 4:30 a.m. Tuesday found the bar empty when they arrived.
Bender was taken by private vehicle to St. John Hospital, where he remained in critical condition early Thursday, spokeswoman Wende Berry said. Bender was taken off life support Wednesday morning but remained alive, a family member told The Detroit News.
Bender's relatives said he retired as an Army staff sergeant because of heart troubles. He was a medic and a veteran of Operation Desert Storm, Angel Bender, his sister-in-law, told The Detroit News.
He was at the club celebrating the news that he no longer needed a defibrillator for a heart condition, Angel Bender said.
Detroit Mayor Kwame Kilpatrick defended members of Detroit's rap community Wednesday, saying most had positive messages.
"I think that the overwhelming majority of the people who would relate themselves to the Detroit hip-hop culture are more into the other elements of hip-hop: clothing, design, poetry, coffee shops," The Detroit News quoted Kilpatrick as saying.
Funeral arrangements for Proof were not released Wednesday.
