I'm 99% sure you have to be in control of the car to get a DUI though. Like in the driver seat and shit. I'm not a cop or a lawyer though so I don't know ask someone who fucking cares.
They can nail you with the intention of driving just by having your keys in your pocket or in reach, and especially if you have the keys in the ignition. There was this guy who was asleep passed out in his truck in the retail 20 minute parking once. The cops arrested him after someone complained their back bumper had been scraped and you could see the paint on his bumper. They told me even though the car was off it was a dui cause he had his keys in his pocket.

I dunno how it works truthfully I just never drink if I plan to drive

law enforcement recommends if you decide to sleep it off, to put your keys in your trunk to avoid the suspicion of an intent to drive.

I think if worse comes to worse, I'll disconnect the battery AND lock the keys in the trunk lol. Luckily I have AAA though I'd just try and get towed home before anything else lol
Lock your battery in the trunk and attach your keys to where the battery is supposed to go and really throw off the cops.

Same lol. They also told me he had patterns of dirt on the right side of his truck indicative of running off a road into a ditch, and splinters in the undercarriagge and wheel wells indicative he took out a road sign somewhere lol
