In Re: Toys 'R' Us - Delaware, Inc. - Fair and Accurate Credit Transactions Act (FACTA) Litigation

The settlement became effective on February 17, 2014 and benefit certificates are expected to be mailed on March 14, 2014 to all approved claimants.

If I remember right this was for $5-10 and you only in Toys 'R' Us gift certificates.

Summary of the Class Action Lawsuit

This lawsuit claims that certain Trader Joe&#8217;s food products were improperly labeled, marketed, supplied, and sold as &#8220;All Natural&#8221; and/or &#8220;100% Natural&#8221; even though they contained one or more of the following allegedly synthetic ingredients: ascorbic acid, cocoa processed with alkali, sodium acid pyrophosphate, xanthan gum, and vegetable mono- and diglycerides. The products at issue are: Joe-Joe&#8217;s Chocolate Vanilla Creme Cookies; Joe-Joe&#8217;s Chocolate Sandwich Creme Cookies; Trader Joe&#8217;s Jumbo Cinnamon Rolls; Trader Joe&#8217;s Buttermilk Biscuits; Trader Giotto&#8217;s 100% Natural Fat Free Ricotta Cheese; and Trader Joe&#8217;s Fresh Pressed Apple Juice.
Trader Joe&#8217;s denies it did anything wrong or unlawful, and asserts the Products&#8217; labels were truthful, not misleading, and consistent with the law. Trader Joe&#8217;s has agreed to this proposed settlement solely to avoid the further expense, inconvenience, and distraction of any burdensome and protracted litigation and to be completely free of any further controversy with respect to this lawsuit.

I just got this email today about the LCD Indirect Purchaser :
Dear Claimant:
You are being sent this email because you filed a claim in the LCD Indirect Purchaser Class Action Settlement. This email is to provide an update on the court proceedings in this case which directly affect when payments will be disbursed under the Settlement.​
As of April 2013, the United States District Court for the Northern District of California had granted Final Approval of settlements with all of the Defendants in this case. Soon thereafter, appeals were filed by individuals/entities who had objected to the settlements, which appeals are currently pending in the 9th Circuit U.S. Court of Appeals. Based on experience with that court, it is expected that those appeals will not be scheduled for oral argument until the winter or spring of 2015, at the earliest. After oral argument, it could take one to three years for the entire appeal process to be finally concluded.​
Unfortunately, distribution of Settlement Funds cannot occur until after the appeals are all resolved. Hence, at this point, the date of the distribution is unknown but could be delayed for years.​
Receipt of this email does not mean that your claim has been deemed eligible. We are continuing to review claims and we will contact you if your claim is deficient or additional information is needed. Dear Claimant:
We received the claim(s) you submitted in the Canamore v. Wal-Mart Store, Inc. litigation. In accordance with the Claims Administrator&#8217;s duties in administering the Settlement, we are authorized to request further documentation to substantiate your claim(s). In order to validate your claim(s), you must submit the following requested information by email to [email protected] or fax to (206) 876-5201 so that it is received no later than April 4, 2014:

d. I do not have a receipt relating to the purchase of the Product(s) for which the claim is being submitted; and
e. You write &#8220;under penalty of perjury I state the foregoing is true and correct&#8221; and then sign and print your legal name.
3. Provide a completed IRS Form W-9 for tax purposes, which can be located at: http://www.irs.gov/pub/irs-pdf/fw9.pdf

Upon receipt of the above information, your claim will be further evaluated. If no response or an incomplete response is received by April 4, 2014, your claim will be denied without further communication from the Claims Administrator.
