San Jose police report: Suspect in fatal Safeway stabbing confessed to killing - San Jose Mercury News
SAN JOSE -- The man accused of killing a San Jose State student inside a Safeway store on Story Road confessed to stabbing the victim and later told police where he dumped the knife, according to a police report.
Police say Michael Howard, 27, was captured on surveillance video confronting Juan Munoz, attacking him and stabbing him once in the chest, according to a statement of facts filed in Santa Clara County Superior Court.
Howard was formally arraigned on the murder charge last week and is expected back in court on Friday to determine who will be his defense attorney, the Santa Clara County District Attorney's Office said.
The killing happened about 8:35 p.m. Aug. 21 at the Safeway grocery store at the Mt. Pleasant Center near Capitol Expressway.
A witness told police she saw the confrontation and said the suspect approached Munoz, 24, and pushed him in the back, unprovoked. She said a brief fistfight ensued and that the suspect drew a knife and stabbed Munoz once in the chest.
The knife pierced Munoz's heart, according to the statement of facts.
The witness identified a photograph of Howard as the suspect.
Howard was arrested the day after the killing. He told investigators that he cleaned the knife and disposed of it in the restroom of a nearby restaurant. Crime scene investigators found the knife and observed blood stains in the restroom, according to the statement of facts.
The statement of facts did not provide any motive for the attack.
Munoz studied business administration and accounting at San Jose State and has been described by family members as a beloved son, brother, nephew, cousin and friend.
Howard is being prosecuted for a previous offense involving a knife. He was arrested by San Jose State University police on June 12 and has been charged with a misdemeanor count of drawing and exhibiting a knife in a rude, angry and threatening manner, according to court documents.
Howard allegedly brandished a knife at a man and threatened him at a light-rail station, according to an SJSU police report. The man told police that Howard used a derogatory racial term when threatening to kill him.
The man was in the parking lot area of the McDonald's restaurant on North First Street near Karina Street when he was approached by Howard, whom he had not met before, according to a police report. At first, the two men passed each other and exchanged nods and hellos.
The man told police Howard continued to stare at him and said after a while Howard asked, "What are you looking at?
The man said he put his duffle bag down and responded by asking, "Do you have a problem?
At that point Howard left, the man told police. The man said he walked to the light-rail station, where he was again approached by Howard. The man told police Howard was holding a black knife in his hand and said, "I'm going to kill you."
The man ran away. After watching Howard board a light-rail train, he eventually got on a later train and exited at the South Second Street station, where he saw Howard once again. The man yelled to Howard: "You want to stab me? OK, wait right there" and then flagged down two university police officers who were inside a Starbucks coffee house.
Howard briefly ran away before officers caught up to him. Police located a black knife with a two-and-a-half-inch blade. Officers also found a bottle of insulin and four syringes. Howard told university police he has diabetes.
