I need some questions answered from whoever might kno...

So Ive been out of work since may 21st. I tripped over a curb in this dark area of my work and my knee started to get swollen. My boss comes in and starts doin some paper work for workers comp and shit. So he tells me "Workers comp doesnt pay for the first 3 days so im going to give you modified work for those three days.".. i think ok thats fine. So I work for those first three days and then im out for like a week and a half..and then I realize i havent recieved one red cent from workers comp. I hit them up and left a message that they still have yet to return. So I call the main branch of my work yesterday and this broad on the other end tells me "Well, since you worked for those three days, you might not be entitled to workers comp benefits"... Ive been googling for nearly 2 hours now and i can't find shit on if thats true or not. Anyone know?

A co-worker gave me the number to an attorney and shit. I ain even trying to go that route tho..

well i work in a pharmacy so i deal with work comp all day, and all i can say is good luck. It generally takes over a week for them to start and process your paperwork, if its not a serious injury. ALOT of people try and take advantage of the system so they have become overly careful. My guess is that if your boss stands up for you and talks to someone then you may get some benefits. I wouldn't expect too much tho. Its a difficult process to go through and make sure that you dont over exaggerate your injuries because they will find out how serious it is. If you lie to them now, then they will think you're lying to them if you get hurt again. Honestly, see what you can get but dont push it too far, its not worth it for what you'll end up getting from them.

Even though i have been to the doctors about 4 times within three weeks?, have paper work saying i was injured and have prescription for Ibuprofen from my doctor for my knee?


make sure that you dont over exaggerate your injuries because they will find out how serious it is. If you lie to them now, then they will think you're lying to them if you get hurt again. Believe me i didnt overexagerate. I have even 2 witnesses who work over there that seen my shit hella swollen. The doctor even said it was swollen. Im not asking for like thousands for this shit, i just want the week i was out to be compensated.


so a company can get around workers comp by having the injured worker come in for only a few days?

I think if it was that bad of an injury you should of went to medical and then took it from there. If your work does not have a nurse/doctor then you should of took the rest of the day off or went to the doctor after you got off work. Think about it.....you get hurt at work, continue working for the next 3 days and then take 2 weeks off and expect to get paid? I dunno the rules by the book or anything but it sounds like your boss fucked you or you fucked yourself...

If you EVER get hurt at work, you need to go home and see a doctor. When it comes to work comp, NEVER listen to your employer, they're goal is to protect themselves and not to make sure that you get your benefits. You might just have to chalk this one up as a loss and learn from it. But if your really hurt then you might get a few hundred from them and some free pain meds. If you have any specific questions just PM me and ill ask this guy i work with, hes like a work comp specialist.

im on workers' comp right now

my injury was a bit more severe though so think it made the process easier considering there is no way i was going back to work anytime soon.

this is my first time with it,and i couldnt be happier,literally had a check that next week.

so i dont have much info to offer but maybe like kay said,that gray area when you worked might of fucked your claim cause i know my adjuster didnt want me doing SHIT after i got hurt cause it would effect my case.

thats the reason i am stuck here on siccness all day now,haha

I went str8 from work to the hospital when it happend.
yeah,then went back to work. that tells workers comp neither the doctor or you thought it was bad enough for you to miss work.

your employer was just trying to protect himself from a claim,coax you back to work cause he knew when you went back to work it would be curtains for your case

i went back to work on modified work. I wasnt standing lifting or none of that.. jus typed some shit here and there for a few hours and then left.

if they really nickle and dimed me out of that im going to shoot the place up.. :angry:

why do you think health insurance keeps goin down hill? cause companys can't afford that shit. exactly why your boss told you to keep on workin so they wouldn't have to pay for your injuries. your boss is not lookin out for your best interests, he's lookin out for his own inside the company...

What the lady told you was not true. If you were on modified duty, you still are available for compensation. Its actually a 3rd party insurance company who pays out the dues anyways, and you should be in contact with them.

Its basically like an insurance claim. Just make sure you let them know that the extent of your injuries are too much for even modified duty, otherwise they'll just find some other shit for you to do, and you won't get the time away from work to 'recover'.
