State Narcotics Agent Testifies In Shooting Death Trial

State narcotics agent Mike Walker believed he was in "imminent danger" of being shot by a man he believed to be a dangerous gang member when he shot and killed the man, according to testimony Tuesday in Walker's manslaughter trial.
Walker, 34, testified that he believed Rudy Cardenas (pictured) was Northern Structure gang member David Gonzales when he chased him down an alleyway in downtown San Jose on Feb. 17, 2004.
"He was certainly acting in a manner in which a fugitive, armed and dangerous, would act," Walker testified.
After hopping a chain link fence down the alleyway, Cardenas rotated clockwise and Walker believed he saw a small semi-automatic pistol in Cardenas' hands.
"I thought he was going to shoot me ... I shot him before he shot me," Walker testified.
Walker testified that he fired two multi-shot bursts before Cardenas moved out of sight behind a blue minivan.
No gun was ever found on or near Cardenas.
Walker maintained a conversational tone with little emotion in his voice as he testified about the shooting before a packed courtroom, including more than a dozen fellow law enforcement officers sitting in silent support of him.
Walker faces a possible sentence of 10 years in prison if convicted.
