State Narcotics Agent Testifies In Shooting Death Trial

State narcotics agent Mike Walker believed he was in "imminent danger" of being shot by a man he believed to be a dangerous gang member when he shot and killed the man, according to testimony Tuesday in Walker's manslaughter trial.



Walker, 34, testified that he believed Rudy Cardenas (pictured) was Northern Structure gang member David Gonzales when he chased him down an alleyway in downtown San Jose on Feb. 17, 2004.

"He was certainly acting in a manner in which a fugitive, armed and dangerous, would act," Walker testified.

After hopping a chain link fence down the alleyway, Cardenas rotated clockwise and Walker believed he saw a small semi-automatic pistol in Cardenas' hands.

"I thought he was going to shoot me ... I shot him before he shot me," Walker testified.

Walker testified that he fired two multi-shot bursts before Cardenas moved out of sight behind a blue minivan.

No gun was ever found on or near Cardenas.

Walker maintained a conversational tone with little emotion in his voice as he testified about the shooting before a packed courtroom, including more than a dozen fellow law enforcement officers sitting in silent support of him.

Walker faces a possible sentence of 10 years in prison if convicted.

that pig didnt act in no self defense....he knew what he was doing...and killed an innocent man...he deserves to rott in prison.....

much love and respect to the cops trying to protect the city and I make their jobs harder but to the fuckin crooked juras fuck em they bitches trying to blame you for something you didn't do, like my homeboys cousin locked him up because his car resembled a murder scene car, and they didn't even do a full examination no he's locked up for 10 years. MY UNCLE WAS SHOT AND KILLED BY THEM PIGS HERE IN UTAH, HE WASN'T A MEMBER OF A GANG AND HE LOOKED WHITE THATS WHY WE CALLED HIM WEDO. NEIGHBORS HEARD THE PO PO'S SAYIN THEY WERE JUST GONNA TAKE HIM OUT, AFTER THE HE WAS WILLING TO COME OUT AND SURRENDER,WHICH HE DID,PANICED..TURNED TO RUN AND SNIPERS TOOK SHOTS, AND LEFT HIM FOR DEAD FOR MORE THAN A HALF OUR WITH NO MEDICAL HELP. AND FUCKED UP THE CRIME SCENE.THOSE PIGS TOOK MY HOMEBOY SNOWMAN FROM DA NORTE OUT WITH 32 SHOTS WITH MORE THAN 5 WHEN HE WAS ALREADY DOWN AND GONE,STRIPPED HIM AND LET HIM LAY LIKE A TROPHY IN FRONT OF SURROUNDING WITNESSES. HE WAS STRAPED AND HE HAD SHOT AT A PIG EARLIER THAT WEEK. BUT HE NEVER HAD THE CHANCE TO BLAST ONE LIKE THEY SAID HE ATTEMPTED TO, CAUSE THE STRAP IMPRINTED A WELT ON HIS HIP! WOULDN'T YOU THINK THATS A SOLID CASE? AND THESE PIGS HAVE THE NERVE TO HERASE WITTNESSES AND CALL US THE FUCKIN CRIMINALS N GANGSTAS. THE GOVERMENT IS THE MOST CROOKED YET HATED MOBSTERS TO LIVE, UNTILL MARSHAL LAW KICKS IN. THEN THEY WILL BE STUNNED WHEN ALL THESE PIGS START TO FALL, I THINK THEY SHOULD BE PENALIZED AS THE TROOPES IN IRAQ WITH THAT PRISONER ABUSE BULLSHIT.OR KILL EM ALL
