If you haven't seen the on going class action lawsuit against Wal-Mart for discrimination of its female employees;

The question this creates for me and the same goes for similar class action litigation of this nature;

Doesn't the lawsuit presuppose that female employees are as productive/competent as male employees?

What if male employees are simply better employees? Wouldn't it stand to reason that they then get paid more and promoted more often?

Thoughts?

Well, is there empirical evidence that would support this? Have they conducted any research to even entertain sucha hypothesis?


I think the burden of proof should lay with those bringing the lawsuit, because they are the ones claiming that Wal-Mart is currently doing is wrong.


Either way, suppose there is empirical evidence to support that claim; do women still deserve equal treatment if they are not equal employees?

I know a big reason cited for the disparity is women's much higher potential for maternity leave.

Most managers realize there is a higher probability of losing a woman employee to maternity leave (statically proven) so given the opportunity they choose to invest organizational resources in employees less likely to leave, which is completely logical and reasonable.
