A San Jose dentist accused of fondling a 14-year-old girl’s breasts during a dental examination in his office will stand trial next month, according to the Santa Clara County District Attorney’s Office.Benva Lazar, 56, was indicted Monday on two counts of felony sexual battery by fraud and one count of lewd and lascivious acts on a 14-year-old girl from San Jose. According to prosecutor Kevin Smith, Lazar told the girl during a dental examination on Aug. 14, 2008, that she was of the age where he needed to check her for cancer and then molested her.Police arrested him on Aug. 10.Lazar is also accused of groping a 40-year-old woman on June 26,2004, after a wisdom tooth extraction.His trial is scheduled to begin Nov. 9.If convicted on all charges, Lazar faces a maximum sentence of five years in prison and would have to register as a sex offender, according to district attorney spokeswoman Amy Cornell.On Friday, Lazar was sentenced to nine months in county jail,
three years probation, and 250 hours community service for a previous battery conviction involving six women. Lazar was arrested in October 2008 on a felony warrant that stemmed from the first investigation of sexual battery involving an adult victim, according to police. After police announced his arrest, five additional adult victims came forward with similar allegations, police said. The incidents occurred between August and October 2008, Smith said.According to police Sgt. Ronnie Lopez, during the court proceedings, the district attorney’s office and the defense reached a plea bargain and Lazar pleaded no contest to six counts of misdemeanor battery involving those victims. In that case, Lazar had been charged with 15 counts of sexual battery of varying degrees, according to district attorney’s office spokesman Nick Muyo.
