FREMONT -- Two men who witnessed the gang-related killing of a Fremont man said in court Monday that they followed the gunman, pushed him to the ground and held him until police arrived.
Timothy Galvan and Fidel Torres -- described by a deputy district attorney as members of the Norteos gang -- are charged with killing Jose Mendoza, 31, with a blast from a sawed-off shotgun Jan. 4.
The charges include gang enhancements, which could carry the death penalty.
Mendoza's brother, Adalberto Mendoza, and family friend, Jose Becerra Carranza, testified through an interpreter during Monday's hearing -- held to determine if there is enough evidence to hold the two men for trial.
The hearing, at the Fremont Hall of Justice, is scheduled to resume today.
Both identified Galvan as the shooter.
Mendoza said he saw Galvan wearing a red bandanna over his face, approach the open garage of the Mendoza home on Viola Court at 9 p.m. Red is the color of the Norteos gang. He was three or four steps from Jose Mendoza when he yelled "puro norte" (pure north), then fired one shot, hitting Mendoza in the right side of the chest. The man then turned the gun toward Carranza and another friend, and fired again, barely missing them, the witnesses said.
Then Adalberto Mendoza chased Galvan, catching him near the sidewalk.
"I pushed him and he fell to his knees and I grabbed him from behind so he couldn't shoot me," he said. "Then I grabbed both arms and laid on top of him."
During the struggle, Carranza held Galvan's feet while the other friend grabbed the gun.
Mendoza said he saw Galvan, slightly injured in the struggle, being loaded into an ambulance, no longer wearing the bandanna.
About 20 minutes before the shooting, two vehicles pulled up in front of the Mendoza home in the Cabrillo area, where the Mendozas and two friends were playing pool.
None of those men are gang members, Deputy District Attorney Joe Eichhorn said.
At least one man got out of the first vehicle, discovered later to have been stolen, and got in a second vehicle. As it sped away, the occupants yelled gang slurs toward the home.
A vehicle returned 20 minutes later and the shooting started.
After he shot Jose Mendoza, "he fired toward where I was and I dropped to the floor," Carranza said.
Mendoza and his family are from Mexico and living legally in the United States, Eichhorn said. The four men worked in construction.
He described Mendoza, who left behind a wife and 2-year-old child, as a "hard-working Fremont man not affiliated with gangs."
Norteos are born in the United States and consider Mexican nationals a Sureo, or enemy.
