Security Deposit question..

Ok, so I moved into my current place 2 years ago, and the rent was $1050 per month with a $500 security deposit. I also payed $525 because I moved in on the 15th. Last year, the rent went up $25 so now I've been paying 1075 per month.

So i give my 30 days notice a few days ago, and I get all the paperwork from the office. It says:

"Our records show that you payed $1550 as a security deposit, of which $1075 will be applied. We will return the remaining $475 to you blah blah blah...

$475??! Is that legal that they can take the $25 rent difference off the security deposit?? I'd ask my parents (its their deposit anyway) but I'm not really talking to them at the moment so now I turn to you, my loyal siccness peeps..

Did you pay your last months rent? If not, they can use the deposit for towards that and return the rest. If you did pay, then they should return the majority of your deposit. Also, they cannot deduct standard things like painting and new carpet, because landlords are required to make those 'repairs' by law before they rent it to a new tenant. Its called something like 'normal wear and tear'...something like that.

@fanatikal..this is my college apartment that im moving out of because i graduated and am moving into a new one, douche..

@shea..yeah i feel u, the first apartment i had the bitch tried to keep hella money from the deposit but then i made her see the error of her ways :)

@dana..yeah i already paid up for the end of july..im bout to march to that office right now and set them straight..these fuckers can't deduct shit from anything less than $500..

Landlords are usually shifty when it comes to giving back deposit money. I had problems with the bitch that ran the last place I rented. They gave me this huge ass check-in list of shit to "grade" when I moved in. I half assed the form like fuck it because I just wanted to get the shit done and move my stuff in. 14 months later that came back to haunt me when they started deducting money from my deposit for every little thing imaginable. Fucking horseshit like runs in the screen that were already there but I failed to point out. That cunt even charged me for the expenses to have a professional cleaning service come out to clean the bathrooms even though we had already cleaned them. When it was all said and done they stung me for over a bill.

If you have a copy of your original lease that you signed along with copies of your cleared rent checks you might have a case. Unfortunately it will most likely wind up costing you much more than 25.00 to take the case to court and win. I went back over my orig lease when I started getting fucked over on the deposit but the slimy landlords had filled all the legal gaps with lawyer speak to cover their asses.

If I was you I would take the money and be happy it was only 25.00 that they got you for. If you feel the need to get even you could always fill the heater vents with dogshit or something.

its the principle of it tho man..your security deposit is UNTOUCHABLE until they check the place..i havent even moved out yet or done the inspections and they're already taking $25 out..

basically they're saying they're gonna deduct from 475, not 500, which was the original deposit..

i know what ur sayin about the 25, but its shady shit like this that landlords are always tryna perpetrate..

so when i moved in to my current place, we painted the walls cuz they said we could, but they said we need to paint them back to white when we move out...since they paint anyways, why do i need to paint the walls back to white?

You are lucky to be getting anything back, 99.9% of the time landlords keep the entire deposit.

make sure they didnt already go check your apartment without letting you know.
