how and where do i go to clear samples? i'm not making many copies of cd's (250) so would it matter to clear it still? and should i put the sample credit in the insert whether i clear it or not?

i wouldnt worry about it unless it starts getting some radio play even then i wouldn't worry lol i think a lot of cats dont clear shit

real shit....its probably less trouble for u to have them persue legal actions(which i doubt unless you blow up off one of them tracks) then it is to actualy try to get the samples cleared and pay money for permission

The best way to avoid clearing samples is to purchase samples from companies like http://bigfishaudio.com/ I use them because you never know when your going to knock one out the park. And who might be listening to your shit getting interested in your music. I'm not knocking samples but I would avoid them just for certain legal reasons. The worlds just so fucking sue happy these days a little kick or clap may cost you a $1,000,000 cut out of your check you worked hard for. Just a thought!!!

^^^^yea that's real. well, the song i sampled was actually a video game of one of the biggest selling characters for nintendo (mario). so i'm really trying to figure it out. nintendo seems very personal than the normal company cuz even trying to download a video game off one of them sites, you can't even download any of the mario games.

I would try to make it as discrete as possible meaning "No One Can Just Listen And Say Hey It's Mario" But if It's not going to big It would probably be ok. Next time just try to find some "LEGIT" samples Dawg!!! I know theres a lot of video game sounds out there that are ready for purchase and you could probably find what your wanting out of them. Theres a lot of "Arcade" sound effects etc out there. Good Luck With The Track!!!

^^^thanks man for the info. and right on to everyone else too. yea lol where can you get those arcade sound effects at? honestly, when i did it, it was just out of fun and expression. the artist who used it liked it and it went from there. i also had thought about replaying it but i think it would take away from the feel of the track as well as the song. actually it's gonna be 500 copies. is that still coo y'all think?

being that the release is gonna be limited edition with limited copies, i was also thinking about putting a "for promo only" thing somewhere in small print lol. what y'all think?

Honestly if anything arises "Which I Doubt Will" you could just say that you found some samples in a pack on the net and you just used em'. Say "I didn't know it was from Mario" and it was 'PROMO USE ONLY" In which means to them you made no money and being that's the case use of there sound was "Royalty Free" Meaning no cost to you. Arcade sounds can be found all over for example - http://www.basementarcade.com/arcade/sounds/sounds.html In this case you could use that site to fall back on. Also try http://www.powerfx.com/soundlibrary/soundeffects Good place for sound effects etc. One of my personal favorites is the Sony Sound Effects Series I have volumes 1-10 and when purchasing they'll hit ya Vol.1-5 for $250.00 and Vol.6-10 for $250.00 in my case "Totally Worth It" but there's tons of free shit out on the net Dawg. But if you ain't got a lot of cash now just download em' and purchase em' when you do. Basically your just "Borrowing" Hope that helps ya!!!

It really dont matter.. Look at Stunna Glasses & Ghost Ride It.. those songs blew up regardless. Sure, it prevented em from ever being released officially, but still erybody n their mama has the song and they were on the radio. In this day and age, does it really matter? Look at how things are spreading and becoming popular. Those songs made it without even being cleared.

not really, those songs got shelved and basically so did the artists that put them out. Niether Fab or the Feds are on major labels right now. and just cuz 100,000 people DLed your song doesnt mean you blew up. virtual dollars aren't real dollars. If anything not having those samples clear fucked their shit up big time

I seriously hope neither you, nor anyone else who reads it actually believes that bullshit. For the millionth time, IT DOES NOT MATTER IF YOU PROFIT OR NOT! Ignorance is not an excuse. If you use a copywritten work without the written consent or license to do so, you are subject to legal action, PERIOD. Making up whatever silly reason to justify it to yourself, or a court if you get caught, isn't good enough.

This subject has been discussed many times before and all the answers are already available via the search option.
