Police unravel slaying of 'Double D'

Almost 2 months of investigation produces leads, motives, suspects in what started out as a case with little to go on
By Harry Harris, STAFF WRITER
OAKLAND -- It's the kind of case homicide investigators dread. A lack of witnesses, no obvious motive and no real leads.
Budding rapper Daryle "Double D" Anderson was dumped near his Adams Point apartment on Aug. 15, his body riddled with bullets, left for dead.

But after weeks of wading through evidence, including phone records and a bullet-peppered Mercedes and interviews with suspects, a topless dancer and others, police said Wednesday they know why the 23-year-old Anderson was shot to death.

They also know who shot him, suspected San Leandro drug dealer Saemdy Peou, 22, and an unnamed 17-year-old Oakland youth who are both in custody.

But they are not charged with murder yet -- just drug and weapons counts, authorities said.

The Alameda County District Attorney's office has so far determined they were acting in self-defense, trying to thwart a drug rip-off Anderson and a friend were attempting. But they could still be charged as more evidence is developed, police said.

The only person charged with murder in the case is Anderson's friend and suspected accomplice in the botched robbery, Jason Nious, 20, of San Francisco.

Even though Nious did not kill Anderson, he was charged under California's felony murder rule that allows a suspect in a serious crime to be charged if an accomplice dies.

Homicide Sgt. Mark Dunakin said Peou, Nious and the teenager all admitted their involvement in the attempted robbery and shooting. He said Peou and the teenager "tried to put most of it on each other."

Dunakin, who investigated the case with Sgt. Lou Cruz, said Anderson's killing, "was definitely one of the most unusual cases I've had and one of the more complex. There were lots of twists and turns and just a lot of legwork com-pared to most."

Dunakin said he was always optimistic the case would be solved. "I always thought we had a good chance -- I just knew it was going to take a lot of time to put it together."

Anderson was found with multiple gunshot wounds about 7:50 p.m. Aug. 15 on the street near his apartment in the 200 block of MacArthur Boulevard. Police said he shared the apartment with his girlfriend, a San Francisco topless dancer.

He died at 8:28 p.m. at Highland Hospital -- where Dunakin said the girlfriend lied about her name to medical staff.

Dunakin said as far as most people knew, Anderson was an aspiring rapper who had just cut an album.

But he also had another side that police found out about later, Dunakin said. He was trying to become an Ecstasy and marijuana dealer. That goal and his greed led to his death, Dunakin said.

At first, with witnesses police were not sure could identify anyone and a lack of motive, Dunakin and Cruz relied on standard investigative procedure: find out as much as you can about the victim and who they knew.

They were able to identify Anderson's girlfriend and obtained Anderson's telephone records to see who he had talked to before he was killed.

Among them were Peou and Nious, although at first they did not know the connection.

But as they continued to probe they developed information that let them put together the events of Aug. 15, details later confirmed by the suspects.

Anderson had bought Ecstasy and marijuana before from Peou, but on Aug. 15 placed his biggest order ever with him -- thousands of tabs of Ecstasy, Dunakin said.

A suspicious Peou, fearing a possible rip-off because of the large amount ordered, still agreed to meet Anderson at the MacArthur apartment. But on his way there in his gold Mercedes, Peou, who was carrying a gun, picked up the 17-year-old to serve as a back-up and gave him a semi-automatic pistol, Dunakin said.

Peou's fears were valid, Dunakin said, as Anderson had recruited Nious in a plot to rob Peou. "I think they got greedy," Dunakin said.

When the Mercedes pulled up at the apartment, Anderson got in the front seat and Nious in the rear where the 17-year-old was sitting. When Nious pulled a gun the teenager started grappling with him in the back seat.

Peou pulled his gun and he and Anderson started fighting in the front seat. At one point Nious' gun fired, as did Peou's, but no one was apparently hit then, Dunakin said.

Nious and the 17-year-old got out of the car and exchanged shots as Nious ran off, Dunakin said. Peou was able to get out of the car with his gun drawn and both he and the teenager started shooting from opposite sides of the car at Anderson who was desperately trying to climb into the back seat, Dunakin said.

Dunakin said police never found a gun on Anderson.

Peou and the teenager then drove about 100 feet away from the apartment before they stopped and shoved the multi- Peou was arrested Sept. 17 after police served a search warrant at his home on Via Toyon Street in San Leandro. Dunakin said a car rented by Peou yielded three assault rifles, a handgun and a large amount of Ecstasy, marijuana and methamphetamine. His wife surrendered the Mercedes to police the next day. It still had bullet holes in the seats and other parts of the interior, Dunakin said.

At a motel room that Peou rented in Oakland to transact his drug deals, police found two more guns and another large amount of Ecstacy, Dunakin said.

Peou implicated the 17-year-old who was arrested Sept. 19, leaving his Oakland home on East 22nd Street. Dunakin said he had some Ecstasy hidden in his underwear. Nious was arrested Oct. 2 at his home on Fillmore Street in San Francisco.
