question on renters insurance...

alright, its been raining for the past two days and they are working on the roof on my building. The roof on the unit to the top right of mine caved in about an hour ago. The maintenance man and his posse came knokkin on my door askin if we had water leakin into our apt. Do the renters affected live rent free until the problem is rectified.....also if they dont have renters insurance are they SOL for items lost/damaged?

ive only taken a coulpe bus.law courses and watched alot of judge judy but…:

from what i kno …in CA u can WITHHOLD rent until required repairs are made. but you still will owe it once repairs are completed and have to pay…


if possessions are damaged they may want to talk to a real lawyer, but there is most likely a fee for the consultation; and they may want to seek free resources such as reddit/legaladvice first…

thanks man, they got me up here lookin at these freshly painted surfaces hopin they hold up. Im gonna look in to renters insurance.

if something structural or part of the building fell on you (*wink,wink) you have a Personal Injury Claim; far more valuable than rent or damaged possessions... but talk to a real legal advisor not the sicc... lol

As long as it is habitable and not a safety risk, then you will not live rent free.
However, if you need to be diplaced then you can take it up with your landlord and he can claim it through his insurance. Landlords "should" have "Loss of Use" coverage meaning if they need to put you in a hotel or another apartment unit for the time beign then their insurance will pay them for their loss of rent.

You won't get any discounts or days off of your rent. You can ask him to put you somewhere else though. If he does decide to discount your rent, that's more of a courtesy call. Not legally required.

Also, renters insurance is the wrong term. Renters insurance is something you would carry to protect your personal belongings. IE - Television gets stolen, damaged by rain, fire etc...
