Ok so I was thinking when someone makes a beat and you like it and want to use it on your album/mixtape you gotta pay them for it right? Well what I was wondering is, when someone puts out an instrumental album, like MF Doom has, does that mean those beats are now free to use? Or would you still have to pay Doom for them?

unless it states on album that it is royalty free you have to pay to use those beats.just like if you bought an album that you wanted to sample a bar, just cause you bought the album does not give you the rights

What 50cal said and the same applies for mixtapes. Nothing is royalty-free unless explicitly stated AND that artist has the rights/ownership to say so.

If you're sampling someone's beat tape, there's a strong chance they never cleared the underlying samples (if applicable) to begin with, so it's not like *they* are going to sue you (not that it makes it legal)

It doesn't matter if they cleared the samples or not. If you didn't then your subject to legal action. Also, whether or not you make money has nothing to do with anything. One of the biggest misconceptions is 'if I put for promotional use only on it and don't profit, I'm legally safe'. WRONG!
