Question about harrasment at a job

heres some history.........

me and my boss dont like each other.i told her how i felt about her and her management skills.she wrote me up a few weeks back for calling in too much and leaving work early.from that point on she knew how i felt.she cut my hours prior to that,i asked her why and she didnt give me an answer.thats pretty much were this stems from.............


tuesday she called me in the office again.she had a write up in her hand.she told me "why dont you save yourself the hassle of this write up and a bad referral (which is a against the law) and just leave,quit".i told her i aint quittin.she went on to say "i want you to quit","leave","get out of here".she said i aint happy here and i go around stirring up bad water about here and the company,i told her that no one really likes her and its not just me and they wont tell her that cus there scared of her,she said hah thats a joke,i told her shes kidding her self.she again told me to quit..........

she went and talked to the district manager and he said just to write me up and any more write ups wil result in suspension up to termination.she opened her mouth and before she could speak i told her "i aint gonna quit cus YOU wants me too"...............


so heres where my harrassment question is...........

the next day there was an all staff meeting.i didnt go cus i never do.but when i went to get my check that night a couple of guys that went told me what it was about.it was pretty much all about me but non-direct.she was sayin how "this employee wont quit cus he thinks i want him to quit,hah go figure".sayin how i always talk bad about her and the company and saying shes unproffessional.talkin bout no more mrs' nice manager and pretty much she was pissed..............is that a form of harassment? talkin about me infront of everybody but not saying my name..............

then my acting supervisor calls me and tells me that she (boss) said im only working one day a week now.so obviosly she wants me outta there............


at that job they wont fire you because they gotta pay unemployment.i know that from another supervisor.thats fine but that bitch done already broke hella rules.she said she'll give me a bad referral,but thats against the law.when she interviewed me she asked if i had a car,the bitch obviously dont know the laws...........


if that is harrament,what should i do.i already caled h.r. and made a complaint about her threatening me with with a bad refferal but h.r. was pretty much on her side..............the ignorant ass h.r. lady didnt even know of the law...........

carry a recorder in your pocket and put her aside, then make her bring up the fact that she threatend u. catch that on tape and blackmale her with it.....haha!!!!!!

Technically the HR person or the person who give referrals can only say that so and so worked from this date to this date. They cannot give their oppinion about how great or poor the worker was. That is not to say they dont do that still, but former employers arent supposed to.

but my situation was... my daughter was due may 25... but didnt come till june 2, and he denied me time off and told me if i didnt come into work i would get fired... so i went above his ass and called human resources for denying me time, he got a write up and was told he can be sued and i can have up to 3 months off whenever i wanted to take care of my child.... bitch has been pissed at me ever since

Sounds like you're giving your boss plenty of reasons to shit on you. You said yourself that you got written up for calling in sick too much and leaving early. What do you expect? How often are you calling in sick? I was in the same situation at an old job. I built up a lot of sick hours and I was always getting hammered for it. I got written up every month if I was over the sick time limit for the year....and it didnt matter if I hadn't taken a day off or not. As long as my shit was over the limit still I was getting written up.

Now, if she is telling you that you should quit, it's because she's covering the companies ass by getting you to quit rather than firing you. They are not obligated to pay unemployment if you quit. Unless you quit due to some circumstances that were out of your control.

Where in the law does it state that a previous employer cannot give you a bad referal? If you called in sick and left work early a lot then they have every right to advise your next potential employer of your attendance problem.

I say, be smart about it. Go to work every day. Don't leave early and dont give that bitch a reason to bust your balls. I dont know how they can cut your hours, but that sounds like bullshit to me. Straighten up and start talking to her boss or HR. Build up a case for yourself, give them a reason to believe you and show them that you are an asset to the company.

i dont think you understand,this is a bullshit job.bullshit money,i dont need it.my whole thing is her talking behind my back and if shes breaking any laws.i would quit.i wanna quit.but i dont wanna give her the satisfaction of kicking me out unless she fires me you know?

im not planning on being there much longer regardless,but she's a bitch and she aint gonna win.............

plus i been callin in and all all that because she shitted on me first.thats a long story,but basicly after that other employees told me there stories about her,shes fucking and fucked alotta people.so i prety much give a flyin fuck about the job.im just there cus im already there.as far as right ups,i understand those,thats coo,but theres a limit to what she can do and shes exceeding that limit............

they dont have any right broham.its a misdemeaner to give a bad referal.before i called HR with the complaint i called the labor union to double check,they told me if she gave a future employer a bad referal and i had a witness,i could press charges with the d.a..........all you can say by law is that you worked there from this date to this date,your job title,and pretty much thats all............
