EMMIS has filed suit over SPANISH BROADCASTING SYSTEM's flip of its KXOL (EL ZOL 96.3) to Hurban as "LATINO 96.3." EMMIS claims that the flip violates terms of SBS' tower lease with EMMIS (KXOL's antenna is on KPWR (POWER 106)/LOS ANGELES' tower), which it says allows it to evict SBS from the tower if it uses the station to compete formatically with KPWR and requires 45 days' written notice of a flip.
