Photography, Legal Situation

Lets say some artist I did a photoshoot with use one of the picture for his album artwork and that album comes out nationwide. Nothing strange so far. But the artist never paid me, and I never signed him a release to allow him to use my picture. How is the legal situation with that?

Not sure if it's the same as building a website, but unless the client has a legal contract releasing rights to them, the client doesn't own your work.

If they didn't pay I know 100% they don't have rights.

we own everything that comes out of our lens unless we sign them over.its funny this one guy that owns a local clothing line tryed to tell me i had to ask him permission before i posted any photos hahhaaahahha and said cause he didnt just want them in any magazines or something(um dumbass thats free advertisement anyways)dude said some other shit but i forget what he said.but when he said that i told him i own everything unless i sign them over to him then he says oh ok..well just let me know then.

Damn I have this document that lists all the photographers rights. But yeah you can take a photo of any building from any public property such as the sidewalk and they can't do shit about it.

Thank you very much for that. As far as who it is. I cant say the name right now. I know the cover is handed in 100% and should come out in the next 3 month (Koch release), I also know 100% they using my pictures. And like I said I sent them a bill a couple times but they never paid so well ... as soon the album hit the stores its on baby!!!

IF THATS THE CASE THEN WHY DO FOLKS SOMETIMES NEED TO GET PERMITS?

I think it depends. Like if I wanna release a photobook of artist XY I gotta get the permission of XY to release the photo and make money with. If the photo was done at a public event (like an award show) I can release the photo like that.

Same the other way around, if artist XY want to publish a photo I took, he needs my permission.

It all depends if stuff is for commercial use or not. Also if the person / building is NOT the main subject on the building, I can release it how I want it.

How did he get a hold of your photos?

I put them on their harddrive. I dont know if that was a big mistake, but with that I gave them an invoice. And still sending invoices to them so I have dates and proof that they got the invoice.

Ouch yea...I would have made them pay the invoice before giving them the pics...but since its too late for that atleast you keeping track of your records and invoices....
