The guy who hit who? Did you even read the article, you idiot? His cousin was in the passenger seat. The drivers car went off the road and ultimately his cousin was thrown out the window and died. There was no car-on-car collision.

So like I said: how can the driver be held financially liable when the passenger willingly hopped into the car in the first place?

Yea I hear that, but that's something to say if he crashed for speeding and it was his fault or something of that sort, in this case dude was drunk and caused a DEATH! Put yourself in his position.
I never knew seat belts were designed to only save you from things you might get yourself into, but not something someone else might get you into.
Just because you are in the passenger seat, doesn't mean the driver has that batmobile armor going on over the car and ain't shit gonna happen.

Fuck car accidents and the people in it for the cash. I have got into two of them and both times the people were trying their best to get some cash from me. Trying to show off some bootleg bruises they got from the seat belt, requesting to be taken away by the ambulance immediately.. Thankfully, no one ever died in my accidents. I am just glad I ain't balling because the court cases never went through in their part to sue. :hurt:

What I don't get is how the court system let's these drivers keep their DL with more than 2 DUIs.. Like that guy in Santa rosa i believe who had 6 fucken DUIs that ended up hitting and killing that lil girl acouple months ago.. There needs to be a limit to where counciling isn't going to cut it anymore and they just need to revoke DLs for life.. Fuck the bullshit..

I used to work as a law clerk for a personal injury firm doing car accident work. You can sue for wrongful death. You gotta find out if the state you live in follows contributory negligence or comparative negligence. In some states, since your cousin assumed the risk, its a complete bar to recovery. Other states can hold that the driver was 50% at fault and the passenger was 50% at fault. If they find the total claim to be 1 million, then the driver would be liable for $500,000.

Your cousin having knowledge that the driver was drunk and not wearing a seatbelt factor into it, but at the end of the day, it was the driver who fucked up and operated a vehicle while drunk and killed somebody. Either way, the money doesn't come from the driver, it comes from his insurance company.

Edit: There's also a dramshop act that will let you sue any establishment that sold alcohol to the driver during that day.
