Mix Tape Question

I asked this N the wrong forum i guess.
I was reading producers N rappers talkin about coming out orbeing on a mix tape.
I have a really hard time comprehending on using a beat so rappers can spit over. Do you have to pay ( whomever beat belongs to) a price to use for a mix tape or jus jackin for beats??? thanx

it depends.....for one if your makin a profit off it or not....and how big a profit.....

most people i know use beats for promotional reasons only....free downloads or battle songs on the net....shit like that......but if you actually makin a mixtape pressing it up and selling it then you risk the chance of being sued if you dont get the clearance to use that music and more importanly pay for that clearance.....thas jus what i understand at least....im sure Heresy can tell you more about this shit......

Normally even if you sellin your mixtape, as long as the product says "For Promotional Use Only" and you don't put a Bar code on the cd sleeve, you shouldn't have to worry about any legal action. Now if you put your bar code on there, then it could cause you problems. What ever stores you sell them to can provide their own bar code for mixtapes...

from what i understand many companies that press cds wont even press your shit if it uses copyrighted material on it without the proper clearance....i noticed some of them say they will put "for promotional use only" on all your cds if you dont provide proof of clearance......

Well with a mixtape you don't need cd replication, you would rather the cheaper version which is cd duplication, and there are plenty companies that specialize in cd duplication for mixtapes. As far as replication goes where they use a glass master, you're right, they won't do it. If you check most mixtapes unless they are offically licensed, most if not all are done using short run duplication.

Technically you can be sued even if you put "For Promotional Use Only" on your mixtape, leave a barcode off and are giving it away for free. Legally, if you profit in any way the copyright owner has a justifiable case against you. It doesn't have to be strickly financial gain. What that means is if you made a mixtape and used all Dr. Dre beats for example, and because of that mixtape got a recording contract with some record label, Dre could in essence claim that you profitted from his work and file a legitimate lawsuit against you.

The good news is most people arn't going to pay money to sue someone who doesn't have anything. What sense does it make to sue some wannabe who probably barely scrapes by in the first place? There's nothing to gain.

Realistically, I wouldn't even worry about it. Sueing people over stealing music and putting it on some mixtape is almost never worth the expense to persue legal action.

Not only that but mixtape are becoming part of the norm, a now viable promotional tool, that even the biggest artists are doing without licensing... Shit if they can do it and profit, so can the lil man. Just be smart about how you go about it. Shit sell it. Rasputins has a whole section dedicated to mixtapes. There are sites such as mixtapemurder.com who sell unlicensed mixtapes. It's a part of the game. Until the big wigs squeeze it from existance, it's fair game. Shit most of the up and coming artists signed to Majors on the East are mixtape artists.... It's a new monster that cats should study first, and take precautions with...

Well I know when Jin first started ( that Chinese doode who made that cut "LEARN CHINESE"; yea it annoyed me also) he would sell the artwork for his mixtapes and it came wit the free CD or whatever.. sum sh it like that but he sold hella copies and he never faced any lawsuits so whatever works.

People usually sue for one of two reasons. To recover money or to make a statement. No point in sueing someone for money when it would cost you more in legal fee's than could be recovered, and nobodys going to pay any attention to a chinese kid getting sued over a mixtape so you wouldn't be making much of a statement.

As long as your not being belligerent about it, nobody in a position of power is going to waste their time punking you over some mixtape.

Been out for awhile. Thanks for the Nfo N feedback ive been gettin. The more i read how these artists startin off with mixtapes the more easy or Nteresting it gets as to being a lil producer or DJ myself.
I got another Question, while readin that answered, How iz it differ to trying to sell a mixtape than a album to a music store?? .........thanx
