Man impregnates girl, 15, while on probation for sex with 13-year-old

A 25-year-old Madison man who went to prison after having sex with a 13-year-old girl in 2005 has been charged again with having sex with a teenager, this time for allegedly impregnating a 15-year-old.
Zachary S. Erickson, who has resided in DeForest, Sun Prairie and Madison, was charged Wednesday with two counts of sexual assault of a child under 16 for his sexual encounters this summer with the 15-year-old girl.
According to the criminal complaint, he met the girl when he accidentally sent a text message to a friend of hers and she ended up answering it. Erickson and the 15-year-old exchanged text messages and phone calls and finally began meeting each other.
The girl said the first time they had sex was after she met him on the north side of Madison and they walked to Erickson's apartment near Williamson Street. They later had sex at her house as well, she said.
Police were called after the girl learned she was pregnant, the criminal complaint against Erickson says.
Erickson was still on extended supervision for his 2005 conviction this past summer when he allegedly had sex with the 15-year-old, court records show. His extended supervision on the 2005 charge, as well as on three misdemeanor counts for other incidents, was revoked and he was sent back to prison Monday to serve about four years behind bars on that count by Dane County Circuit Court Judge Stuart Schwartz.
Schwartz originally sentenced Erickson to two years in prison and four years of extended supervision in that case. Erickson was charged with having sex with a 13-year-old girl in the bathroom of a Waunakee home after giving the girl two beers, court records show.
After his relationship with the 15-year-old girl surfaced late this summer, the Department of Corrections moved to have Erickson's extended supervision revoked. In a hearing on the revocation issue before an Administrative Law Judge Kathleen Kalashian, Erickson said he thought the 15-year-old girl was actually 18.
Kalashian said Erickson violated several terms of his extended supervision regardless of the girl's age. She said she had little sympathy for Erickson's statement that he didn't know how old the girl was.
"Mr. Erickson is on supervision for having sex with an underage girl and he went to prison for that crime. After his release into the community he again had sex with an underage girl. A reasonable person would have taken the utmost care in determining his sex partner's age but Mr. Erickson did nothing of the sort," she said.
Erickson's additional time in prison for the 2005 case pales in comparison to what he could face if convicted on the charges filed Wednesday. Each of those counts carries a maximum term of 46 years of combined prison and extended supervision time
