ANTIOCH — A 3-year-old boy still was on life support this morning, a day after he and his 8-month-old brother were thrown out of an SUV in a roll-over crash on Highway 4, the California Highway Patrol said.
The 8-month-old boy is in stable condition and could be released today, CHP Officer Tom Maguire said. Both children were taken to Children's Hospital Oakland with head trauma.
The crash early Thursday morning also seriously injured the driver, 23-year-old Pittsburg resident Nicole Berry, who was arrested on suspicion of drunken driving before being taken to John Muir Medical Center in Walnut Creek.
Officers at the scene found a pint of Hennessy cognac inside the vehicle, Maguire said.
Berry was upgraded from critical to fair condition this morning. She could be charged with vehicular manslaughter if any of the victims die, Maguire said.
Three other adult passengers in the 2004 Mitsubishi Montero, including the boys' mother, complained of pain after the accident but were otherwise unhurt, Maguire said.
The CHP is recommending that two counts of child endangerment be filed against the boys' mother, 25-year-old Pittsburg resident Shawna George, who failed to properly restrain her children in the two car seats found in the wreckage, Maguire said.
The uninjured passengers were all wearing seat belts. Investigators believe Berry was not, Maguire said. It's unclear where the passengers were all seated.
The crash occurred about 1:20 a.m. in the westbound lanes near Somersville Road, when for unknown reasons, the Mitsubishi swerved to the right onto the dirt shoulder. The driver then over-corrected to the left, resulting in the vehicle rolling over twice before it landed on its wheels.
