I work as a security guard for a bus company and have applied and been hired as a bus driver. I've been through training and have shown the ability to manuver and handle the bus. I took and passed my license test which consisted of straight line backing, alley docking, right hand turning and parallel parking. I also have close to 30 hours of behind the wheel training.

Here is my problem, I have a condition due to CP where my left hand specifically my index finger doesnt close all the way. The DMV code says anyone with impairments cannot drive a commercial vehicle with passenger endorsements. I've been tested by an orthopedic surgeon who says I'm good to drive and my hand isnt an issue, problem is that I need to convince the doctor who initially gave me the physical to agree with the surgeon and sign me off.
I feel I'm getting screwed on a technicality.

California hasnt adopted the Federal Regulation Section which allow people with impairments to drive, They use part of the Federal Regulations but not all of them.

I cant figure out who I would call or write to, to ask that california adopt the Federal Regulations to include section 49 which I qualify under.

Bullshit I say Bullshit.

Technicalities can't beat a loud, annoying ass person constantly in the face of the DMV. I'm sure if you kick up enough dust someone will be able to sign some shit to get you off their case. threaten a lawsuit if you have to...

That is bullshit, why wont they take the report by the ortho surgeon over the doctors? If you cant get it cleared by the dmv, call up your local congressman and the local news, have them show up and pose for the cameras and see what happens.

As for changing the legislature, you have to go through your local politicos for that.

And if you still can't get anything done, sue the DMV for discrimination based on the Disabilities Act.

That's my advice.

Well the DMV is trying to screw me by saying, we'll give you a restricted class B license without Passenger Endorsements, which is required to be a bus driver. The doctor is debating on clearing me outright, despite have the proof from the ortho surgeon. I just faxed him my training reports which are favorable. My hand does not limit me in any way to control the steering wheel.
On my drivers test I passed above the average, less errors than most, On the Road Test portion I only got 13 whereas most get 25 and up out of a 45 error limit.
I'm hoping the doc hooks me up.

The DMV isnt who I need to convince, if the doctor clears me then the DMV cannot give me a restricted license since I'll have 1 ortho surgeon that says I'm good and the Doctor who will admit to making an error by requiring me to have a certificate which is invalid in california and only for inter-state driving and that I meet the mininum physical requirements.
