People use peoples shit from the game all the time, Jay z stole tupacs song me and my girlfriend and made it a shitty remake, that is a hell of a lot more of an injustice to me, than taking a cd title, that was never actually released. Obviously Lou didn't think it was that great of a title because he went with something else for his solo when it dropped. If someone wants to use a title that someone else thought of first but didn't use, it's STILL not even a big deal.
