A judge sentenced an Oakland man Friday to 15 years in prison for a San Francisco freeway shooting in which another man was killed.
The defendant, Joe Nguyen, was acquitted of first-degree murder in December in the March 23, 2003, death of Fabian Herrera. But the jury found him guilty of four assault charges for firing on a car full of people driving south on Interstate 280. Herrera, 23, of Millbrae was behind the wheel.
The panel deadlocked on second-degree murder and attempted murder. Prosecutors have yet to decide whether to retry Nguyen on those charges.
In handing down the sentence, Superior Court Judge Carol Yaggy said Nguyen had "fired multiple shots on a rainy freeway at night while in a car going at more than 65 mph. Everyone in the victim's car could have been killed by what happened here.''
Prosecutors sought the maximum sentence, which could have exceeded 20 years, saying the defendant had not acknowledged his true role in the attack. Nguyen's defense, citing his lack of criminal history, was seeking probation.
Nguyen told Yaggy he "honestly believed'' that someone in Herrera's car had shot at him, something the prosecution has dismissed.
His attorney, Public Defender Jeff Adachi, said the jury felt the true killer was an acquaintance of Nguyen's, Long Nguyen (no relation). Long Nguyen got a deal guaranteeing his freedom in exchange for his testimony.
