PORTLAND, Ore. -- A man who police said shot at U.S. marshals while they tried to arrest him has been released from the hospital and is expected to appear before a Multnomah County judge on attempted murder charges.

Last month, a grand jury issued a secret indictment charging 23-year-old Adam Berndt with two counts of attempted aggravated murder and felon in possession of a firearm.

Berndt may be formally charged Friday afternoon, prosecutors said, depending on his health.

In late August, members of the U.S. Marshals Office and Vancouver police went to the Celilo Court Townhouses near Northeast 95th Avenue and Prescott Street.

There, authorities said, Berndt walked out the front door and started shooting.

A U.S. marshal returned fire and shot Berndt multiple times, investigators said. No officers or bystanders were injured.

Berndt was taken to a local hospital from the scene where he remained for nearly a month in critical condition, according to the U.S. Marshals Office. One of the bullets fired by the Marshals grazed Berndt in the ear and head, prosecutors said.

Berndt was released from the hospital Thursday, prosecutors said.

Authorities said Berndt has also been linked to a shooting outside a Vancouver apartment complex. In that case, Clark County deputies said 29-year-old Steven McKnight was taken to a hospital after being shot four times.

Berndt was also wanted on a charge of parole violation by the Washington Department of Corrections, authorities said.
