I'm in a 12-month lease with my apartment complex that is up in June. I haven't had consistent hot water in 3 weeks. I'm lucky if I get to take at least a part of a shower that is actually hot and not luke warm to cold. They are saying that they have had it looked at and there is nothing wrong with it. Well, obviously there is...or I wouldn't be taking cold showers. I have had them try to fix it 3 times now, which requires me taking ALLLLL of my stuff out of my storage area each time and and requires me to set it in my living room until they are done fixing it. They are trying to tell me that I can't get out of my lease because there is nothing wrong with my hot water situation. What can I do to get out of this lease? Hot water is a basic right of a lease agreement, is it not?

Yes, hot water is a basic right and if your not getting that, then you have a problem...Hound them in writing by certified mail about this problem and document everything (date who you spoke with, responses..etc) if it is not fixed within 1 month, which is more then enough time...Call a lawyer thats good with Tenants Rights, it may be different out there then here in CA....but your problem can be remedied easily with a letter from a lawyer (scare tactic), which will cost you maybe $75....fucked up you should have to pay for it , but you can take them to small claims for the water bills (if any) for reimbursement...as thery were the indirect cause of you not being able to fix the problem....

Call a plumber, pay to get it fixed, then request reimbursement from the landlord, as this was a problem they should have fixed themselved without you having to call an outside agency...

Invite them in to test your shower water (or you and i can take a shower together sometime ??) and them have them tewll you its not messed up...Or just get a plumber to diagnose the problem, tell the problem to your landlord (certified mail) and explain the extenuating cicumstances that you've been goin through (no shower)

its just a matter of time and postage really....if you push hard enough you could have it done within 2 weeks...

Thanks Musty...I been callin...for at least 2 weeks almost every day. Sometimes they don't even return my calls. Dicks! I need to write all this shit down and send a letter. That is the next step. I appreciate the detailed response. I talked to the neighbors a few floors down and they said their water has always run out fast. Dunno if it's all tied in together with the plumbing or what.

In Seattle (which has some of the most consumer protective tenant rights, next to NYC) you can pay to have your basic necessities fixed (i.e. hot water heater) and deduct it from your rent owed. Not sure about landlord/tenant laws in Az though, do a yahoo search for some pro bono lanlord/tenant attorneys to verify...

keep records of EVERYTHING, times you called, certified mail recpts, dates times are important in small claims if it comes down to that...never send anything not certified, its like you never sent it....keep a good record and your case will be solid....give it another week and then start up wit the legal shit....3 weeks is long enough for a simple problem like water to be fixed...sounds like a shitty water heater, which landlords hate replacing cause there $$$$...
If you have other with the same complaints, draft up a group letter or petition demanded such thing be fixed....send it certified...lol

dont lag on doin this....stay on top of it...worst comes to worst, get it fixed and have him deduct it from the rent...but dont just hold out on rent if its not fixed....Make it clear you want it fixed NOW, or further steps will be taken...they cant evict you for standing up for yourself....

Well since I'm unemployed I've been watching alot of People's Court, Judge Mathis, Joe Brown etc so I think I'm qualified on this subject.......

You can NOT just withhold rent...as Musty stated you have to send WRITTEN requests to the landlord (so u have proof)...If they still don't comply, you can hire a plumber and have him do the work...and then subtract that amount from your rent....

Each state has its own Landlord Tenant Act. Check out AZ here.... http://www.tenant.net/Other_Areas/Arizona/AZresidential.html

Under Az law the landlord is REQUIRED to

"Maintain in good and safe working order and condition all electrical, plumbing, sanitary, heating, ventilating, air-conditioning and other facilities and appliances, including elevators, supplied or required to be supplied by him."

and

"Supply running water and reasonable amounts of hot water at all times, reasonable heat and reasonable air-conditioning or cooling where such units are installed and offered, when required by seasonal weather conditions, except where the building that includes the dwelling unit is not required by law to be equipped for that purpose or the dwelling unit is so constructed that heat, air-conditioning, cooling or hot water is generated by an installation within the exclusive control of the tenant and supplied by a direct public utility connection."

If the landlord does not comply

"§ 33-1364.Wrongful failure to supply heat, air conditioning, cooling, water, hot water or essential services

A. If contrary to the rental agreement or § 33-1324 the landlord deliberately or negligently fails to supply running water, gas or electrical service, or both if applicable, and reasonable amounts of hot water or heat, air-conditioning or cooling, where such units are installed and offered, or essential services, the tenant may give reasonable notice to the landlord specifying the breach and may do one of the following:

1. Procure reasonable amounts of hot water, running water, heat and essential services during the period of the landlord's noncompliance and deduct their actual reasonable cost from the rent. If the landlord has failed to provide any of the utility services specified in this section due to nonpayment of the landlord's utility bill for the premises, and if there is no separate utility meter for each tenant in the premises such that the tenant could avoid a utility shut-off by arranging to have services transferred to the tenant's name, the tenant may either individually or collectively with other tenants arrange with the utility company to pay the utility bill after written notice to the landlord of the tenant's intent to do so. With the utility company's approval the tenant or tenants may pay the landlord's delinquent utility bill and deduct from any rent owed to the landlord the actual cost of the payment the tenant made to restore utility services. The tenant or tenants may continue to make such payments to the utility company until the landlord has provided adequate assurances to the tenant that the above utility services will be maintained.

2. Recover damages based upon the diminution in the fair rental value of the dwelling unit.

3. Procure reasonable substitute housing during the period of the landlord's noncompliance, in which case the tenant is excused from paying rent for the period of the landlord's noncompliance. In the event the periodic cost of such substitute housing exceeds the amount of the periodic rent, upon delivery by tenant of proof of payment for such substitute housing, tenant may recover from landlord such excess costs up to an amount not to exceed twenty-five per cent of the periodic rent which has been excused pursuant to this paragraph"
