Arizona state politicians will introduce model legislation this week to encourage states to prevent children of illegal immigrants from being granted citizenship under the 14th Amendment.
Lawmakers in at least 14 states have said they are committed to passing the legislation targeting birthright citizenship. Arizona's anti-illegal-immigrant bill, SB-1070, was also based on model legislation that could be easily copied by states, and at least seven states are likely to pass bills similar to the first Arizona immigration overhaul this year, according to one analysis by an immigrants rights group.

Arizona state Senator Russell Pearce will unveil the bill Jan. 5 in Washington, D.C., the Arizona Capital Times reports. The paper says lawmakers in Alabama, Arizona, Delaware, Idaho, Indiana, Michigan, Mississippi, Montana, Nebraska, New Hampshire, Oklahoma, Pennsylvania, Texas and Utah have said they want to introduce similar legislation this year.

Pearce argues that the "original intent" of the 14th Amendment was to grant citizenship to freed U.S. slaves, and that it was never meant to apply to the children of foreigners. A Phoenix New Times writer, however, argues that lawmakers who originally passed the amendment took into account the cases of children of Chinese immigrants in California as well as children of gypsies when drafting the measure. A 19th-century Supreme Court precedent also backs that interpretation, though no Supreme Court case has yet dealt with the issue of offspring of illegal immigrant parents.
The amendment states: "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

Ali Noorani of the immigrant-rights group the National Immigration Forum told The Lookout that he believes leaders in more states will try to counter the thrust of the birthright initiative by adopting resolutions that eschew state laws cracking down on illegal immigration. Religious and political leaders in Utah recently signed a compact advocating for a "humane" approach to immigration, which other states could copy.

Illegal immigrants are paying taxes to Uncle Sam, experts agree. Just how much they pay is hard to determine because the federal government doesn't fully tally it. But the latest figures available indicate it will amount to billions of dollars in federal income, Social Security and Medicare taxes this year. One rough estimate puts the amount of Social Security taxes alone at around $9 billion per year.

Paycheck withholding collects much of the federal tax from illegal workers, just as it does for legal workers.

The Internal Revenue Service doesn't track a worker's immigration status, yet many illegal immigrants fearful of deportation won't risk the government attention that will come from filing a return even if they might qualify for a refund. Economist William Ford of Middle Tennessee State University says there are no firm figures on how many such taxpayers there are.

"The real question is how many of them pay more than they owe. There are undoubtedly hundreds of thousands of people in that situation," Ford said.

But some illegal immigrants choose to file taxes and write a check come April 15, using an alternative to the Social Security number offered by the IRS so it can collect income tax from foreign workers.

"It's a mistake to think that no illegal immigrants pay taxes. They definitely do," said Martha Pantoja, who has been helping Hispanic immigrants this tax season as an IRS-certified volunteer tax preparer for the non-profit Nashville Wealth Building Coalition.

So coming into a country and killing all the natives that live there is perfectly fine? Mind you, Mexicans did own most of the southern/west America before we killed and pushed them out. So they should at least get to live in places like Texas and California for free and however they want. Blame it on us for declaring we own those places when we clearly didn't.

I'd be more pissed off at the government spending then "Jose Diaz" not pitching in 10g's every year that would just go to war funding anyways. You know, the reason their not here anymore...

Anyways, this law is bullshit. I've been fixin' on illegally immigrating to your country so I can have babies who become Americans, while skipping out on paying taxes. what am i supposed to do now.

is that what really happend or do you just not know your history? or do you only know the "chicano activist" version of that history lesson?

chicanos always want to fight for the land "once" owned by mexico, yet they dont want to cross the border and live in the country where their raza is trying to escape........thats a good back bone for an argument.

I'll keep it real, we don't "own" this land and we don't have the right to invade every country. We might as well go to war with Mexico at this point, it would be less insulting to the people.

illegal workers cant legaly obtain a SS# to pay fed tax.......if they pay fed withholding, then they got a hot SS#........

if they dont have a stolen SS# then they aint payin no fed.......
