[12/3]Three Shot, One Killed In Oakland Gun Battle

OAKLAND, Calif. -- Mayhem took over the streets of Oakland Thursday night where police said a running gun battle between the occupants of two cars left three shot, including one man killed by officers after refusing to lay down his weapon.

The altercation ended at 64th and Bancroft with a deadly officer-involved shooting when police cornered two suspects at an apartment building.

Authorities were still sifting through evidence at the crime scene late Thursday where officers were forced to shoot two men, leaving one dead.

This shooting happened around 5:40 p.m., ending a violent incident that covered miles of city streets and I-580.

Investigators are saying little about how the conflict started, but police sources told KTVU that it began as a confrontation and shooting between two cars at 35th and MacArthur. .

The cars then raced onto I-580 and caused some kind of accident with innocent bystanders at the Edwards exit.

At that location, there was another shooting.

Then, at least two suspects ended up at the Foothill Plaza apartments, where the officers confronted them in the garage.

“When officers went to go detain the suspects, they were confronted with armed suspects,” said Oakland Police spokesman Jeff Thomason. “Officers did fire their weapons. One of the suspects was shot and killed here at this location.”

Sources told KTVU that police recovered two firearms at the scene: an assault rifle and a shotgun.

“The officers, in fear for their life, discharged their firearms after asking the subjects to drop their firearms,” said Assistant Police Chief Howard Jordan. “We are in the preliminary stages of the investigation.”

Appearing conscious and alert, the suspect who survived was taken to the hospital by ambulance.

New Oakland Police Chief Anthony Batts came by the scene briefly to get an update from his officers.

He declined to comment on the case before he left. This was the first time Batts has appeared at a crime scene. He was greeted warmly by other officers on the scene.

KTVU learned Thursday night on the street that some people have nicknamed the apartment complex "the carter", after the crack house in the movie new jack city.

Residents say they live in constant fear of violence.

“Makes you very leery going out and coming in to the building,” said one apartment complex resident. “Kids got to stay inside but sometimes that's not safe. I'm done.”

One woman said she doesn't live at the complex, but the father of her children do. Those children were there when the shooting happened.

“I'm just terrified and scared because I just lost one son. And knowing all this stuff is going through -- bullets is flying through, my kids is up in the house -- I was just really scared,” said Tamika Hamilton. “Like when I first saw all these cops here, I was just hysterical.”

Officials from the Oakland Police Department's homicide and internal affairs units and the Alameda County District Attorney's Office are investigating the shooting.

There have been six officer-involved shootings in the city this year, four of which have been fatal, Thomason said. There were 11 officer-involved shootings in Oakland in 2008.
